Eesyload (Pty) Ltd is licensed to You (End-User) by Eesyload (Pty) Ltd, registered in the Republic of South Africa (hereinafter: Licensor), for use only under the terms of this License Agreement.
By downloading the Application from the Apple App Store, Google Play Store, or any other authorized platform, and any update thereto (as permitted by this License Agreement), You indicate that You agree to be bound by all of the terms and conditions of this License Agreement, and that You accept this License Agreement.
The parties to this License Agreement acknowledge that Apple and/or Google are not parties to this License Agreement and are not bound by any provisions or obligations with regard to the Application, such as warranty, liability, maintenance, and support thereof. Eesyload (Pty) Ltd, not Apple or Google, is solely responsible for the licensed Application and the content thereof.
This License Agreement may not provide for usage rules for the Application that conflict with the latest App Store Terms of Service or Google Play Terms of Service. Eesyload (Pty) Ltd acknowledges that it has reviewed such terms and this License Agreement does not conflict with them.
All rights not expressly granted to You are reserved.
Eesyload (hereinafter: Application) is a piece of software created as an on-demand load-moving platform – customized for Apple and Android mobile devices. It is used to connect customers needing furniture or heavy loads moved with drivers who have suitable vehicles.
The Application is not tailored to comply with industry-specific regulations (such as those relating to medical or financial data), so if your interactions would be subject to such laws, you may not use this Application. You may not use the Application in a way that would violate any applicable financial or data protection laws.
2.1 You are granted a non-transferable, non-exclusive, non-sublicensable license to install and use the Licensed Application on any Apple-branded or Android devices that You (End-User) own or control and as permitted by the Usage Rules in this section, the App Store Terms of Service, and Google Play Terms of Service.
2.2 This license will also govern any updates of the Application provided by Licensor that replace, repair, and/or supplement the original Application, unless a separate license is provided for such update, in which case the terms of that new license will govern.
2.3 You may not share or make the Application available to third parties (unless permitted by Apple or Google terms and with Eesyload (Pty) Ltd's prior written consent), sell, rent, lend, lease, or otherwise redistribute the Application.
2.4 You may not reverse engineer, translate, disassemble, decompile, remove, modify, combine, create derivative works of, adapt, or attempt to derive the source code of the Application, or any part thereof (except with Eesyload (Pty) Ltd's prior written consent).
2.5 You may not copy (except as expressly authorized by this license and applicable Usage Rules) or alter the Application or portions thereof. You may create and store backup copies only on devices You own or control, subject to this license and applicable store terms. You may not remove any intellectual property notices.
2.6 Violations of the obligations above, or attempts at such infringement, may result in prosecution and claims for damages.
2.7 Licensor reserves the right to modify the terms and conditions of this license.
2.8 Nothing in this license restricts applicable third-party terms. When using the Application, You must comply with applicable third-party terms and conditions.
3.1 Licensor will endeavour to keep the Application updated to support new versions of firmware and hardware, but You are not entitled to demand such updates.
3.2 You are responsible for ensuring that the device on which You intend to use the Application meets the required technical specifications.
3.3 Licensor reserves the right to modify technical specifications at any time.
4.1 The Licensor is solely responsible for providing any maintenance and support services for this licensed Application. You can contact the Licensor at the email address listed in the App Store or Google Play overview for this Application.
4.2 Eesyload (Pty) Ltd and the End-User acknowledge that Apple and/or Google have no obligation to furnish any maintenance or support services with respect to the licensed Application.
You acknowledge that Licensor may access and process Your personal information and Application content in accordance with this Agreement and our Privacy Policy available at: https://eesyload.com/privacy.
The Application may allow You to submit reviews, ratings, feedback, comments, or other content (collectively, "Contributions"). Contributions may be viewable by other users and third parties. Any Contributions You transmit will be treated as non-confidential and non-proprietary. By submitting Contributions, You represent and warrant that:
Any use of the Application in violation of the above may result in termination or suspension of Your rights to use the Application.
By submitting Contributions, You grant Eesyload (Pty) Ltd an unrestricted, irrevocable, perpetual, non-exclusive, transferable, royalty-free, worldwide license to use, copy, reproduce, disclose, publish, display, reformat, translate, transmit, and distribute such Contributions for any purpose, including commercial purposes, in any media now known or hereafter developed.
You retain ownership of Your Contributions but waive moral rights therein. We are not liable for statements in Your Contributions. We may edit, re-categorize, or delete Contributions at our discretion without notice.
8.1 Licensor’s liability for breach of obligations or tort is limited to intent or gross negligence, except for breach of essential contractual duties, where slight negligence may also attract liability. Liability is limited to foreseeable, typical damages. This limitation does not apply to injury to life, limb, or health.
8.2 Licensor is not responsible for damages caused by Your breach of Section 2. You are advised to use available backup functions to prevent data loss.
9.1 Licensor warrants that the Application is free of known spyware, trojans, viruses, or malware at the time of download and functions substantially as described.
9.2 No warranty applies if the Application fails due to unauthorized modification, inappropriate use, incompatible hardware/software, or factors outside Licensor’s control.
9.3 You must report defects by email within ninety (90) days of discovery.
9.4 If a defect is confirmed, Licensor may remedy it by repair or replacement.
9.5 To the extent permitted by law, app store operators have no warranty obligation.
Eesyload (Pty) Ltd, and not Apple or Google, is responsible for addressing any claims relating to the Application, including product liability, non-conformance with legal requirements, and consumer protection or privacy claims.
You represent that You are not located in a country subject to international sanctions prohibiting use of the Application and are not listed on any restricted parties list.

The license remains valid until terminated by Eesyload (Pty) Ltd or You. Your rights terminate automatically upon breach of any term. Upon termination, You must cease use and delete all copies of the Application.
Eesyload (Pty) Ltd will comply with applicable third-party terms. Apple and its subsidiaries are third-party beneficiaries of this Agreement with respect to Apple devices and may enforce it against You.
Eesyload (Pty) Ltd, and not Apple or Google, is solely responsible for investigating, defending, settling, or discharging any third-party intellectual property infringement claims relating to the Application.
This Agreement is governed by the laws of the Republic of South Africa, excluding conflict of law rules. Disputes shall be subject to the exclusive jurisdiction of South African courts.
17.1 If any term is invalid, the remainder remains valid, and the invalid term will be replaced with one achieving the original purpose.
17.2 Amendments must be in writing. This clause may only be waived in writing.
